Se le señala de delitos de contra la salud y posesión de armas de uso exclusivo de las Fuerzas Armadas.
Un juez federal suspendió el juicio, una vez concluida la etapa intermedia, contra Abraham Oseguera Cervantes, alias “Don Rodo”, hermano del líder Cártel Jalisco Nueva Generación (CJNG), Nemesio Oseguera, “El Mencho” hasta que se resuelva el amparo que tramitó contra la vinculación a proceso que se le dictó por los delitos de contra la salud, en la modalidad de posesión de metanfetaminas con fines de venta, y posesión de armas y cartuchos de uso exclusivo de las Fuerzas Armadas.
“Don Rodo”, preso en el penal del Altiplano, busca echar abajo la vinculación a proceso que le impuso el juez de control del Centro de Justicia Penal Federal, con residencia en Almoloya de Juárez, Estado de México, Mario Elizondo Martínez.
El titular del Juzgado Cuarto de Distrito en materia Penal, Daniel Marcelino Niño Jiménez, no le concedió la suspensión a “Don Rodo”, debido a que no la solicitó.
Sin embargo, ordenó al juez de control Mario Elizondo Martínez, abstenerse de declarar la apertura del juicio oral, hasta que quede firme la sentencia del juicio de amparo.
“SE ADMITE la demanda de amparo. SUSPENSIÓN. Sin que se aperture el incidente de suspensión en virtud de no existir solicitud expresa y tampoco estar en los supuestos a los que se refiere el artículo 127 de la Ley de Amparo. REQUERIMIENTO AL JUEZ DE CONTROL. No obstante, de conformidad con el párrafo segundo de la fracción XVII, del numeral 61, de la Ley de Amparo, se solicita al Juez de Control responsable, para que, suspenda el procedimiento en lo que corresponda a la parte quejosa, una vez concluida la etapa intermedia y hasta en tanto quede firme la ejecutoria de amparo que se dicte en el presente juicio.
Elementos del Ejército, Marina, Secretaría de Seguridad y Protección Ciudadana (SSPC) y de la Fiscalía General de la República (FGR) recapturaron en febrero pasado a “Don Rodo” en el poblado de Atajeas de Covarrubias, municipio de Tonaya, Jalisco.
Durante su detención, las Fuerzas Federales le aseguraron drogas y armas de grueso calibre.
Víctor Beltrán, abogado de “Don Rodo”, acusó a los guardias nacionales y los elementos del Ejército mexicano, de sembrar armas y drogas en el domicilio de su cliente.
